Tell Committee Members to Remove Section 453 of the Interior, Environment, and Related Agencies Appropriations Bill for FY 2026
On Tuesday, 7/22, the House Appropriations Committee will be discussing the Interior, Environment, and Related Agencies Appropriations Bill for FY 2026. This bill contains Section 453, which would block funding for the EPA in approving product labels or taking regulatory action that conflicts with its own, potentially outdated, human health assessments.
As a result, product labels could remain locked in place despite new scientific evidence—leaving children and families vulnerable to harmful chemical exposures that may impact fertility and other aspects of long-term health.
The provision also effectively shields companies from legal accountability. By preventing label updates and limiting lawsuits, it removes a key mechanism for holding manufacturers responsible for the safety of their products.
The language of the bill is carefully crafted to avoid directly calling this “immunity”—but the effect is the same: companies would not be held liable for the health consequences of their products.
ACTION TO TAKE Call members of the House Appropriations Committee and ask that they remove Section 453 of the Interior, Environment, and Related Agencies Appropriations Bill for FY 2026. Calls are most effective, especially if you are a constituent of a Committee member.
TALKING POINTS You can include the points below in your message. Be sure to mention if you are a constituent of a committee member when calling.
Blocks Label Updates: • Defunds EPA's ability to approve updated pesticide labels when new science shows health risks. • Prevents informed consumer consent by freezing outdated warnings.
Creates Legal Immunity via “Impossibility Preemption”: • Victims can’t sue for failure to warn if companies are barred from updating labels. • Courts dismiss cases, claiming companies can’t comply with both state and federal law.
Broad Scope – All Pesticides Affected: • Impacts over 57,000 current products and all future ones under FIFRA. • Includes common household items like disinfectant wipes and bug spray.
Major Health Risks: • Includes chemicals linked to cancer (glyphosate), Parkinson’s (Paraquat), and infertility. • Families lose critical warnings as infertility and other health concerns rise. • Opens the door for unchecked chemicals with no fear of legal consequences.
